scott bud you mean is at the scene of the crash. >> reporter: let me show you where it happened. along marrowry and argonaut in fremont. a street some witnesses told us was an accident waiting to happen. >> a chaotic scene this morning after fremont police officers say the nissan rogue lost control coming down this street. hitting and killing a 44-year-old man in the process of moving a piano. the suv also hit a trailer and knocked over a fire hydrant. >> unfortunately the pedestrian died at the scene. the driver was injured and had to be transported to a local hospital for treatment. >> witnesses describe the crash as frightening. >> you could hear the boom and water splattering everywhere. >> any often say cars drive too fast and recklessly here. >> they don't look or pay attention. there is either someone trying to merge and don't acknowledge

another car coming from the right. so it's just an unsafe intersection. >> officers say the 57-year-old driver of the suv was injured then taken into custody for driving under the influence. by flying a drone over the scene they tried to recreate how one car could do so much damage. >> obviously an overhead view of the scene is very helpful. and in trying to recreate, trying to get a picture what have occurred. >> in fremont, scott budman, nbc bay area news. well, it's a photo that seems innocent enough. but it may have led to four sheriff's deputies losing their jobs. because one of the men in this photo is a known felon. nbc bay area first broke the story with a push alert sent from our app and a tweet from our reporter damian trujillo, damian is live at the sheriff's office with more on the photo and the quick action by the sheriff. damian. >> reporter: yeah, janelle, the sheriff's office says they do not comment on personnel matters

but sources confirm the firings to us and the known felon in this case will be familiar to many people. nbc bay area obtained this photograph exclusively. it shes several retired deputies at a birthday party of a known felon. that felon is a familiar face to many people. he is armand tiano, a former sheriff lieutenant convicted in 2001 of lewd conduct with two underage female relatives. >> the sheriff's office does have a standard of conduct policy. that policy reflects on duty conduct as well as off duty. >> several police chiefs tell me sworn police officers should never associate with known felons. >> it's disappointing because all peace officers when they come into the business they know that their conduct and their associations are critical, because they are held to a higher standard. >> a former president of the santa clara county police chiefs association spending 32 years in local law enforcement, the picture was from tiano's pirgt

day party four of the men pictured are retired but working in the courts as extra help until a sheriff fired them. >> i think it seems appropriate and sends a message not only to other deputies but to the public that we want our people to maintain a good moral approach to their life. >> reporter: he says it doesn't matter if the felon is a buddy or excolleague. and today the sheriff was praised for acting quickly in this case for firing the deputies. live at san jose, damian truly onbc bay area news. >> thank you so much. developing at this hour the devastating wildfires in southern california burning out of control tonight. a live look from the chopper. you see the glow in the background continuing to burn at this hour. six major wildfires are burning north of los angeles all the way through san diego. more than 6,000 firefighters are now along the front lines. we begin our coverage with chief meteorologist jeff ranieri looking at the fire conditions

down there remind me so much of what happened in the north bay fires. >> yes and the wind event looks like it continues into the weekend. the weather is not helping firefighters at all. it stays gusty heading into saturday. 20 to 35-mile-per-hour gusts possible sunday as high as 45. swreel to wait until monday and tuesday for the winds to relax. it's out north 10 to 0 on monday but better on tuesday 10 to 15-mile-per-hour. so again early next week we should see some help to get the firefighters a little bit of a break on the fire lines. extended forecast continues dry weather the next seven days, temperatures mild in the upper 70s heading from this weekend right into next week. we may start to see it cool off a little bit but generally it looks like the wind as we head through monday and tuesday will be the biggest hem coming. >> and unsundayably warm right now. thank you jeff. another live look from the chopper in l.a. over the fires. in one, the largest one burning in ventia county.

the thomas fire it is night five down there in southern california. the firefighters are strapped thin and worn out. let's check in with nbc jay gray life in ventura. the fire conditions still dangerous down there. >> reporter: yeah, janelle, terry, any really are and going to continue to be. we talked about some of the numbers and we'll share more of those. this is the tragic reality of what the fires are doing. leaving homes in ruins here. and right now there is little help in sight. wildfires continue to rafage southern california right now. >> the thomas fire has now made its way all the way to the pacific ocean. >> reporter: the fires exploded overnight an intense orange glow filling the sky. fire racing across the hillsides. >> we started throwing everything in the car when we saw -- i saw embers starting to

hit the roof. >> reporter: families scrambling to safety ahead of the flames. >> we hopefully will be going to someplace safer and hopefully when we get back our house is still here. >> reporter: hundreds of homes are gone. >> the wind will carry embers up to a mile out in front of the main body of the fire. it makes challenges for the firefighters difficult. coupled with the very dry conditions we have out there. >> reporter: close to 6,000 firefighters are along the front lines of at least six major wildfires burning north of los angeles through san diego. >> god knows whatever else is going to break out during what i classify as the devil winds and the dry conditions that we have. >> it's scarey because it moves pretty fast. >> reporter: race horses scattered at this training center as the flames inched closer. dozens died during the stampede. >> we got a flare-up. >> reporter: as the fires continue to burn uncontained and

out of control. yeah, now look, we have had a bit of a break in the winds in afternoon and into the evening. a big help for firefighters on the front line. unfortunately, though, they expect the winds to kick up again tomorrow through the we could and into next we can. terry and janelle, firefighters tell us timothy plan to be working the wildfires through christmas. it's going to be a tough go. >> and a long haul. >> thank you jay. another live look from the chopper. and there is a shot that gives you an idea how massive the fire is. our coverage will continue throughout the newscasts including they have another live update from you from ventura county the sight what you're looking at there. at 6:30. the office doctor door of an east bay professor vandalized and how he is responding is catching pond. he is turning it into a lesson about acceptance. kristi smith is life on the east bay campus and the tactic is he is using is catching on.

>> reporter: that's right. and campus police say they are investigating six reported incidents like this over the past month. now, an assistant proveser is addressing this through art saying it's catching on. saying others are following suit. he hopes who ever is doing this might think again. posters on this office door were crossed out along with a name tag and another turned around. according to the doctor. an assistant professor at cal state east bay office. >> i saw the post-er cross out and black lives matter across that. >> he works in the educational leadership for social justice program. >> the signs are actively crossed out so i think that in itself is an act of racism. >> university police call it vaned alism. they're investigating six incidents on campus recently. >> fliers and notices have been crossed out. and most of enemy have to do with either an event or a club

of city workers marching in downtown oakland today. after months of negotiations and four days of strike, oakland mayor libby schaff declared the city at an impasse. let's go to anser hassan in oakland. what are the unions saying right now? >> reporter: yeah, janelle, well it depends. the city may or may not be an impasse depending who you ask. the union says they are not at impasse despite what the city says. at the meeting now trying to figure out what comes next. the union is accusing the city of trying to rush it along and unfair labor practices. they tell residents expect more disruptions in services, that the strike is still on. >> the offer that we have made exceeds the cost of living increase in the bay area. >> oaklandary mayor libby schaff defended the city's last best and final offer presented to the union on the fourth day of strikes before declaring an impasse. >> the offer that we have made

to sciu is fair and responsible to both our workers and to the public. >> but oakland city employees don't see it that way. hundreds march through downtown oakland this afternoon. among the big issues, wages. the city did agree to a 4% increase in year one of the contract but could only offer up to a 2% increase the second year. and that's contingent on revenue growth. but the union want it guaranteed money. >> at this point we are looking to try and stay above the rising costs. and we would just with barrel be able to do that about the contract. >> the city made concessions aloindicating half a million to convert library jobs to staff positions process. but the union argues many departments need the same kmiltment. >> if the city reprioritized and

put the work first and the money is there. >> reporter: now, the city says the union can enter into a fact finding phase which drags it out another 5 to eight months. the city also says they are looking at contingency plans to restore services if the strike continues into next week. reporting live in oakland, anser hassan, nbc bay area news. >> thank you very much. new details about the patient who skapd from a psychiatric hospital. we now know his name. it's dorian mulder. the he managed to runway from john george psychiatric hospital in and he leonardo o about 6:30 last night. he ran to the fair month hospital and broke noah car with a teenage boy inside. he drove off with the boy. but then crash the car in the parking lot. mulder tried to car jack another person by biting him in the arm. he ran onto highway 580 where he was hit by the car. he got up and got away again.

deputies brought out a thermal imager which picks up body heat. as you can see that's him there in the bushes along the roadway and arrested him. new video tonight of two pit bulls before they attacked a woman and killed her chihuahua last month in san francisco. police are looking for the owners. the attack happened in the outer mission district .chihuahua died. we brought this story wednesday. the pit bulls were found, tracked down at the humane society after someone saw them on the loose. the owner of the pit bulls is unknown. police want to track that person down. the air quality alert, the first of the winter season. not the last. this is every oh the east bay this afternoon. nbc bay area sam brock joins us live from twin peaks where haze appeared across the san francisco sky line and sam, air quality management officials into uncharted territory today. >> zblsh that's correct for the

first time in history we are looking three spare the air alerts issued preemptively for sunday. we are talking about how bad the fire activity is in southern california. that's not what compromising air quality here. a profile of san francisco that looks a little less golden than usual. the city goers don't seem too alarmed. >> do you see or feel a difference. >> i see the difference but i don't feel feel the difference. >> i notice to do yesterday a little bit. a little bit hazy i wasn't sure if it was related to the fires or not. >> wildfires rafageing southern california from ventura to san diego have coated the communities with smoke. but in the bay area a high pressure ridge off the coast creates of an inversion layer keeping preexisting polluteants and the warmer air below and incoming smoke above out. >> ironically the temperature inversion we have in place over the bay area that's trapping wood smoke and other forms of pollution in the region was

protecting us yesterday from the wildfires smoke that was aloft zblool air quality management say the inversion layer could last days into next week keeping the bay area hazy. in the meantime some environmentalists look at the long game of the fire. >> every fire powers for smoke and cashed into the air. cashed is the major climate changing gas. that means every fire is exacerbating the effects. >> now groups that are concerned about the co2 emissions from the fires are focusing efforts on the rebuild. what kind of homes they're putting in the absolutely devastated communities. that means more efficient homes energy efficiently homes but also less insulation which when it burns is toxic. reporting live sam brock nbc bay area news. >> okay sam. let's get more to the air quality. spare the air declared today and tomorrow. a winter spare the air.

no wood burning. >> it's going to be tough for some folks here as the temperatures start to dip. overall we are going to see some of the worst air quality through marin and napa and sonoma. let's get to you the microclimate forecast. you'll see on the air quality report again it's a north bay with unhealthy levels. the east bay peninsula and south bay will be at moderate. limit the outdoor exposure especially if you have respiratory problems or allergies. as we get a look the big problem with the air quality is we can't get rainfall in to clean the air out. as you'll see the rainfall water update which starts on october 1st runs through july 1st. that's the bulk of our rainfall. we see a deficit right now. santa rosa so far has picked up 7 and .82. all areas now terri ner from one to two inches behind. it's not worst we've seen in terms of rainfall but we definitely need to start

from above of the thomas fire.. you can see it )s still burning its way through veur right now at 6:30, new video to you ton. pictures from above the thomas fire. you can see it's still burning its way through ventura county and just one of six fires. we are tracking the southern california fires right now. firefighters not get ago break from the wind and facing another long night. the fifth night there .. the biggest fire in ventura county within the last hour we got updated numbers. the fire burned more than 130,000 acres. containment at 10%. nearly 90,000 people in that area have been evacuated. hundreds of homes already destroyed. from our sister station is joining us with more from ojai

and patrick another difficult night for firefighters. >> reporter: it is terry and janelle. but as frightening as the numbers are and as thick as the smoke is in ojai and other ventura county communities. the winds have diminished. no kmunlts immediately threatened. firefighters making progress but it doesn't mean the fire is out. look at the video we shot earlier. this is north of ojai along 33 up towards the national forest. as you can see there is active fire in some of the whirlwindness areas outside the communities. at a briefing at the top of the fire fire command reported the burn area increased again to 143,000 acres. that's some 200 square miles. we also got an update on the number of homes burn. 282. i'm sorry 262 in the city of ventura. 158 of them destroyed. but all that was earlier in the week. with the wind easing, the active

both houses of congress passed a temporary funding extension late last night beating the midnight deadline. they have until december 22nd to negotiate a longer term agreement. the president met with congressional leaders thursday to discuss the potential deal. top priorities include defense funding, hurricane and wildfires relief. and money for the children's health insurance program. take a live look at the golden gate bridge looks good but a new report warns traffic in the bay area is getting more dangerous. the metropolitan transportation commission points to a huge jump in traffic deaths since 2010. that report looked at accidents that killed drivers, pedestrian attention and bicyclists. analysts say human error is to blame. the three most common mistakes drivers make are speeding, unsafe turning and driving under the influence. a warning going out tonight in the east bay. concord police say a scammer is trying to convince people that they omoney here how is works.
